Woofyful™ is the customer-facing brand of Neudach LLC, a California limited liability company, 1730 E Holly Ave #824, El Segundo, CA 90245 ("Woofyful," "we," "us"). These Terms of Service ("Terms") apply to your use of woofyful.com and your purchase of custom pet products, including stickers, pillows, ornaments, and gift cards. By using the site, uploading content, or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Refund Policy.
You must be at least 18, or have a parent or guardian's permission and supervision, to place an order.
1. Orders and pricing
Product availability, prices, discounts, and shipping estimates may change at any time. We may cancel, refuse, or limit orders for suspected fraud, payment problems, listing or pricing errors, or other issues that affect fulfillment. If we cancel an order after you've paid, we will refund you in full.
2. Your uploaded content
2.1 Your promises. You confirm that you own or have permission to use every photo, name, image, and other content you upload ("Your Content"). If any identifiable person appears in Your Content, you confirm you have that person's permission (or the permission of their parent or guardian).
2.2 Fulfillment license (default). You keep ownership of Your Content. You give Neudach LLC and its service providers (such as our print and fulfillment partners) a non-exclusive, royalty-free license to store (including with cloud image storage providers), process (including image editing such as background removal by a third-party image-editing service), edit, crop, color-correct, preview, print, and reproduce Your Content only to create, ship, and support your order, to include a photo of your finished product in your order and shipping confirmation emails, and to keep required records. This license ends when your Content is deleted under our Privacy Policy.
2.3 Marketing and showcase use: opt-in only. We will not use Your Content, your pet's image, or photos of your finished product in our website galleries, social media, ads, emails, or other promotion unless you separately opt in (for example, by checking an unchecked box at checkout, or giving written permission). If you opt in, you grant us a non-exclusive, royalty-free, worldwide license to reproduce and display that content for promoting Woofyful. You can revoke it anytime by emailing support@woofyful.com. We will stop new uses within 30 days. We are not required to remove copies already printed or shared by others. We will credit you only with the name, pet name, or handle you choose to give us (for example, on our Share Your Pup form). Otherwise, we won't use your name.
2.4 No AI training by Woofyful. Woofyful does not use Your Content to train or fine-tune its own artificial-intelligence or machine-learning models. Third-party processors, such as our third-party image-editing service, handle Your Content under their own terms (see our Privacy Policy).
2.5 Prohibited content. Do not upload content that infringes anyone's rights, violates the law, or is hateful, obscene, harassing, or otherwise inappropriate. We may decline or cancel any order (with a refund) at our discretion if we believe the content breaks these rules.
3. Custom products and final sale
Woofyful products (custom stickers, pillows, and ornaments, which are printed on both sides) are made to order from Your Content. Custom items are final sale once production begins. We don't offer returns, refunds, or cancellations for change of mind, ordering mistakes, or the wrong photo being uploaded after production starts.
Cancellation: You may cancel for a full refund until your order enters production, which may happen shortly after purchase. Email support@woofyful.com as soon as possible with your order number. Once an order has entered production, it can't be canceled.
This doesn't affect your rights if your order has a production defect, arrives damaged, or is the wrong item. Contact us within 14 days of delivery with photos, as described in our Refund Policy, and we will reprint, replace, or refund eligible orders. Final-sale terms are shown at checkout before you pay.
4. Shipping and delivery
Delivery windows are estimates and can vary with production time, carrier performance, weather, and holidays. If we can't ship within the time we stated (or within 30 days if we didn't state one), we will notify you and give you the option to agree to the delay or cancel for a full refund of the unshipped item. You are responsible for giving us an accurate shipping address. We aren't responsible for orders delayed, lost, or returned because of an incorrect or incomplete address. We will help investigate missing, delayed, or damaged shipments.
5. Payments
Payments are processed by our third-party payment processors. Woofyful does not store full credit card numbers. By ordering, you authorize the charge for your purchase, including applicable taxes and the shipping charges shown at checkout.
6. Gift cards
Woofyful gift cards ($25–$200, delivered by email) don't expire and have no service or inactivity fees. They can be used only on woofyful.com and can't be reloaded or resold. California residents can redeem a remaining balance under $10 for cash on request. Contact us to arrange it. If your gift card code is lost or stolen, we'll replace it if you can show proof of purchase and the balance hasn't been used. Otherwise, gift cards are treated like cash.
7. Reviews
If you submit a review, it must be honest and based on your own experience. We don't remove or suppress reviews because they are negative. We may remove reviews that are unlawful, abusive, off-topic, or contain personal information. If we ever give an incentive for a review, we will disclose it. Your review text is licensed to us for display on our site. Any photos in your review are covered by Section 2.3, so we only display them if you have opted in.
8. Intellectual property
All Woofyful branding, website content, product designs, text, graphics, and logos are owned by or licensed to Neudach LLC and may not be copied or used without permission. Your Content remains yours.
9. Copyright and takedown requests
If you believe content on our site or a product we made infringes your copyright or other rights, or uses your photo or likeness without permission, email support@woofyful.com with a description of the content, where it appears, and the basis of your claim. We will review the request and remove the content where appropriate. We may also suspend future orders from people who repeatedly upload infringing content.
10. Indemnity
You agree to indemnify and hold harmless Neudach LLC and its members, employees, and service providers from any claims, losses, and reasonable expenses (including attorneys' fees) that arise from (a) Your Content, including any claim that it infringes or misappropriates another person's copyright, trademark, privacy, or publicity rights, or (b) your violation of these Terms or the law. We will notify you of any such claim, and you may take part in the defense with counsel you choose.
11. Disclaimer of warranties
Except as stated in our Refund Policy and to the extent permitted by law, the site and products are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Screen previews may differ slightly from printed colors and sizes. Some jurisdictions don't allow these exclusions, so they may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Woofyful and Neudach LLC are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim related to an order is limited to the amount you paid for that order. These limits don't apply to liability that can't be limited by law, such as for fraud, gross negligence, or willful misconduct.
13. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing a claim, please contact us at support@woofyful.com so we can try to resolve it informally within 30 days. Any dispute that isn't resolved will be heard exclusively in the state or federal courts located in Los Angeles County, California, and you and we consent to that jurisdiction. Either party may bring an eligible claim in small claims court instead. Nothing here limits rights you have under consumer protection laws that can't be waived.
14. General
If any part of these Terms is unenforceable, the rest stays in effect. These Terms, together with the policies listed above, are the entire agreement between you and us. We may assign these Terms. Our failure to enforce a provision isn't a waiver.
15. Changes
We may update these Terms. We'll change the "Last updated" date, and material changes apply only to orders placed after they are posted.
